ALBANY — The top state Assembly Republican was busted for drunk driving on New Year’s Eve — just a week after publishing an op-ed warning against the perils of getting behind the wheel under the influence. Assembly Minority Leader Brian Kolb was charged upstate with driving under the influence Tuesday night, according to the Ontario County Sheriff’s Office. Kolb was driving a 2018 GMC Acadia near his home in the upstate town of Victor, near Rochester, when he allegedly crashed his car on County Road 41 around 10:30 p.m., authorities said. No one was hurt and no other vehicles were involved in the crash, according to the sheriff’s department. He was taken to the Ontario county jail and charged with “Unsafe Turn and Driving While Intoxicated” with a BAC of more than .08 percent. Kolb copped to the DUI in a statement apologizing for the incident Wednesday. “Last night, I was charged with driving under the influence near my home. This was a terrible lapse in judgment, one I have urged others not to make, and I take full responsibility for it,” Kolb said in a statement. “I fully recognize the severity of the situation and I am profoundly sorry. There is no excuse and no justification for what occurred Tuesday evening. I made the wrong decision, and it is one I deeply regret,” he added. On Dec. 24, the politician had penned a guest column in the upstate Daily Messenger newspaper warning against drunk driving. “Many of our holiday traditions, especially our New Year’s Eve celebrations, involve indulging in spirits. Done safely, and in moderation, these can be wonderful holiday experiences. However, tragedy can be only one bad decision away,” he wrote, highlighting December’s National Drunk and Drugged Driving Prevention Month. “Do not operate a vehicle if your ability to do so is impaired,” Kolb continued. “Drunk driving is not only dangerous to the driver, but to vehicle passengers, bystanders and other drivers.” Hudson Valley Assemblyman Kieran Lalor, a fellow Republican is now calling for Kolb’s resignation as the Assembly GOP’s minority leader. “That he hasn’t done so already is a disgrace,” he tweeted. Kolb was elected to the Assembly in 2000, and has served as minority leader since 2009. He briefly flirted with running as the GOP gubernatorial challenger to Gov. Cuomo during the 2018 election cycle.
