SC UPHOLDS HIGH COURT ORDER ON MUNICIPALITY RESERVATION; SLAMS GOA GOVT, STATE ELECTION COMMISSION

In a big setback to the state government and the State Election Commission (SEC) the Supreme Court of India has upheld the judgment of the High Court setting aside Goa government's notification dated 4th February regarding the municipal reservation. The SC has rejected all Special Leave Petitions filed by Goa government and Goa State Election Commission.
The Supreme Court further has directed Goa government to notify reservations for Mormugao, Mapusa, Margao, Sanguem and Quepem within 10 days from today and has ordered to complete the Election process for these 5 Municipal Councils by 30 April. The Apex Court also slammed the Goa government for giving additional charge of State Election Commissioner to Law Secretary while giving orders to state for an appointment of an independent SEC.
In the meanwhile, the top Court has ordered each and every SEC 'who is having post of SEC as an additional Charge' to step down immediately.
It may be recalled that the Supreme Court on March 4 had quashed the High Court's order which had set aside a notification by the Directorate of Municipal Administration on the reservation of wards of Mormugao, Margao, Mapusa, Quepem and Sanguem municipal councils.
Following SC's order, the State Election Commission has rescheduled the elections for the 5 municipalities to March 21. The remaining 6 municipalities and CCP will go for polls on March 20 as per the earlier announced schedule
